CORTLANDT– New York State Troopers were dispatched to a domestic disturbance that occurred on Ely Road in Cortlandt, on August 21, 2016.
Police said their investigation revealed the defendant, Martin Costello, age 56 of Cortlandt, was outdoors working on his vehicle when the victim returned to the Ely Road residence.
The defendant reportedly entered the garage and grabbed a Panther Arms A-15 assault rifle, according to authorities.
The victim was able to enter the home and contact 911 for police assistance.
It was discovered after the victim entered the home, the suspect discharged a round from the firearm from his garage into the backyard towards occupied homes, according to authorities.
New York State Police from the Cortlandt barracks arrested Costello for Criminal Possession of a Weapon 3rd Degree, and Reckless Endangerment in the 1st Degree, both Class D Felonies.
Costello was arraigned in the Town of Cortlandt Justice Court and remanded to the Westchester County Jail in lieu of $2,500 cash bail or $5,000 bond. He is due to return to the Town of Cortlandt Court at a later date.
